This Privacy Policy explains how Ape Technology (“Ape,” “we,” “us,” or “our”) collects, uses, discloses, and protects information when you use the XR Stock Heatmap: Walk Through the Market application (the “App”). By accessing or using the App, you agree to the practices described in this Privacy Policy.


1. Information We Collect

a. Account and Profile Information (User Profiles)
When you create or use a user profile in the App, we may collect and store information such as:
• name and/or display name (as provided by you or your platform account settings, where available);
• email address (if you register with email);
• username, profile ID, and authentication tokens (as applicable);
• profile preferences (e.g., watchlists, selected sectors, filters, layout settings, comfort/UX settings, language);
• profile history related to App usage settings (e.g., last opened view, saved heatmap configurations).

Note: We do not require you to provide sensitive personal data to use the App. Please do not include sensitive information in your profile fields or support requests.
b. Usage and Analytics Information
We may collect information about how you interact with the App, such as:
• features used (e.g., filters, highlights, sector navigation);
• session timestamps, frequency, and interaction events;
• aggregated usage patterns to improve UX and performance.
c. Device and Platform Information
We may collect technical information about the device and XR platform you use, including:
• device model, OS version, app version, language settings;
• IP address, approximate region (derived from IP), and network information;
• platform identifiers and device identifiers made available to developers by the XR platform and your permissions.
d. XR Interaction Data (If Enabled/Required)
To enable core XR functionality, we may process certain interaction data, such as:
• headset/controller position and orientation;
• hand tracking / gesture input states;
• interaction events within the 3D environment (e.g., selection, grabbing, pointing).

We aim to minimize collection of XR data and, where feasible, process it locally on your device. We do not intend to collect a “map” of your physical environment unless the platform and your settings explicitly provide it and it is necessary for a feature you use.
e. Support and Communications
If you contact us, we may collect the content of your message and related metadata (e.g., email address, date/time), and any information you choose to share.
f. Payments / Purchases (If Applicable)
If the App offers in-app purchases or subscriptions, payments are processed by the relevant app store/platform provider. We do not store full payment card details. We may receive purchase confirmation and entitlement information (e.g., subscription status, transaction identifiers) to provide access to purchased features.
g. Market Data
The App displays market data obtained from third-party providers (e.g., Financial Modeling Prep). This is informational market data and is not your personal financial information unless you voluntarily submit personal financial data (which the App typically does not require).


2. How We Use Information

We use collected information to:
a. provide, operate, and maintain the App, including saving and restoring user profiles and preferences;
b. personalize your experience (e.g., saved filters, watchlists, heatmap settings);
c. monitor performance, debug issues, and improve stability and XR usability;
d. provide customer support and respond to requests;
e. enforce our terms, prevent fraud or misuse, and protect the security and integrity of the App;
f. comply with legal obligations and protect our rights.


3. How We Store User Profiles

User profile data (such as usernames, preferences, watchlists, and saved heatmap configurations) may be stored:
Locally on your device (e.g., to load your settings quickly); and/or
On our servers or secure cloud infrastructure (e.g., to allow profile persistence across sessions/devices), depending on the features offered.

We apply reasonable safeguards to protect stored profile data. However, no system can be guaranteed 100% secure.


4. Disclosure of Information

We do not sell your personal information. We may disclose information in the following circumstances:
a. Service Providers: to vendors that help us operate the App (e.g., hosting, analytics, crash reporting, customer support), under confidentiality and data protection obligations.
b. XR Platforms / App Stores: the App may rely on platform services (e.g., Meta / Horizon / Spatial SDK). The platform may collect and process information under its own privacy policy. We only receive platform data made available to developers.
c. Market Data Providers: to retrieve market data from third-party providers. Requests may include technical information (e.g., IP address) necessary to deliver data to your device.
d. Legal and Safety: to comply with law, court orders, or lawful requests; to protect rights, users, and the App; to prevent harm, fraud, or abuse.
e. Business Transfers: in connection with a merger, acquisition, financing, reorganization, or sale of assets, information may be transferred as part of the transaction, subject to applicable law.


5. Data Security

We implement reasonable technical and organizational security measures designed to protect information from unauthorized access, loss, misuse, alteration, or disclosure. Despite these efforts, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.


6. Data Retention

We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, including to:
• maintain your user profile and provide the App;
• comply with legal obligations;
• resolve disputes and enforce agreements.

We may retain aggregated or de-identified data for analytics and product improvement.


7. Your Choices and Rights

a. Account/Profile Access and Updates: You may review and update certain profile information and preferences within the App (if available).
b. Delete Profile: You may request deletion of your user profile and associated personal information, subject to legal and operational requirements.
c. Permissions: You can manage XR permissions (e.g., motion/hand tracking, microphone) through your device/platform settings. Disabling certain permissions may limit App functionality.
d. Marketing Opt-Out: If we send promotional emails, you can opt out using the unsubscribe method provided in those communications.

If you are located in certain jurisdictions (e.g., the EEA/UK), you may have additional rights such as access, correction, deletion, restriction, objection, and data portability. You may also have the right to lodge a complaint with a data protection authority.


8. Children’s Privacy

The App is not intended for children under the age required by applicable law and/or the XR platform’s policies. We do not knowingly collect personal information from children. If you believe a child has provided personal information, contact us so we can take appropriate action.


9. Third-Party Services and Links

The App may integrate third-party SDKs and services (including XR platform components and market data providers). These third parties may collect information under their own privacy policies. We are not responsible for the privacy practices of third parties, and we encourage you to review their policies.


10. Important Disclaimers (Market Data and No Financial Advice)

a. No Financial Advice: The App provides data visualization and informational content only and does not constitute investment, financial, legal, or tax advice.
b. Data Accuracy and Availability: Market data is provided “as is” from third parties and may be delayed, incomplete, or inaccurate. We do not guarantee accuracy, completeness, or uninterrupted availability.
c. Limitation of Liability: To the maximum extent permitted by law, Ape disclaims liability for losses or damages arising from your use of the App or reliance on any displayed data or visualization.


11. International Transfers

Your information may be processed and stored in countries other than your own, where service providers or infrastructure are located. Where required, we use appropriate safeguards for cross-border transfers.


12. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will revise the “Last Updated” date above. Your continued use of the App after changes become effective indicates your acceptance of the updated policy.
